Terms of Service

These terms are the agreement between you and Train Daily. By using the app, you agree to them, so please read them. We've kept the language as plain as we can.

1.Agreeing to these terms

Train Daily is operated by Outsmart Press, Inc. ("Train Daily," "we," "us," or "our"). When you create an account or use the Service, you agree to these Terms of Service and to our Privacy Policy. If you don't agree, please don't use the Service.

2.Who can use Train Daily

You must be at least 18 years old to create a coach or club administrator account. Players are added to a team by their coach or club, not by signing up on their own.

When you add players, you confirm that you have the authority to do so and to share their information with us for the purpose of running the team. For any player under 13, you confirm that a parent or guardian has been given the notice we provide and has given verifiable consent before that child uses the Service. Our Privacy Policy explains how that consent works and the rights parents have.

3.What Train Daily does

Train Daily is an off-day training app for youth soccer teams. Coaches assign daily drills and reinforcement questions. Players complete the training, earn points, keep streaks, and compete on their own team's leaderboard. We provide a library of training videos, and coaches can add their own videos, drill descriptions, and questions.

We may add, change, or remove features over time to improve the Service.

4.Your account

Keep your login details private and don't share your account. You're responsible for what happens under your account. Tell us right away at support@mattmcwilliams.com if you think someone has used your account without permission. The information you give us must be accurate, and you agree to keep it current.

5.Free trial, subscriptions, and billing

The 30-day free trial

Train Daily starts with a 30-day free trial. We require a card to start the trial. You will not be charged during the trial. If you cancel before day 30, you pay nothing. We'll email you before your first charge so it isn't a surprise.

Pricing

Train Daily is priced per player, and the per-player price depends on your club size. Current pricing is shown on our pricing page. You can choose monthly or annual billing when you sign up.

Auto-renewal and cancellation

After the free trial, your subscription renews automatically at the end of each billing period (monthly or annual) until you cancel. You can cancel anytime from your account or by contacting us. When you cancel, you keep access through the end of the period you've already paid for, and you won't be billed again.

Roster changes

Because pricing is per player, we true up your roster monthly. If your player count changes, your charge adjusts so you only pay for the players you have.

Payments and refunds

We process payments through Stripe. By subscribing, you authorize us to charge your card for the plan you chose, including renewals, until you cancel. Except where the law requires otherwise, payments after the free trial are non-refundable. If you think you were billed in error, contact us and we'll look into it.

Price changes

We may change our prices. If we change the price of a plan you're on, we'll give you notice before it takes effect, and the new price will apply to your next billing period.

6.Content you add

Coaches can upload videos, write drill descriptions, and add reinforcement questions ("Your Content"). You keep ownership of Your Content. You give us the permission we need to host it and show it to your team as part of the Service.

You are responsible for what you upload. You confirm that you have the rights to use and share Your Content, and that it doesn't break the law or infringe anyone else's rights. Don't upload anything you don't have permission to use, and don't upload anything harmful, illegal, or inappropriate for a youth audience. We can remove content that breaks these terms.

7.Acceptable use

When you use Train Daily, you agree not to:

• Break the law or use the Service for anything illegal.
• Upload content that is harmful, abusive, or inappropriate for children.
• Try to access accounts, teams, or data that aren't yours.
• Interfere with or disrupt the Service, or try to break its security.
• Copy, resell, or redistribute the Service or our training library outside your own team without our permission.
• Use the Service to collect information about children beyond what running your own team requires.

8.Our intellectual property

Train Daily, including the app, our training video library, our software, and our name and branding, belongs to us and is protected by intellectual property laws. We give you a limited, non-exclusive, non-transferable right to use the Service for your team while your subscription is active. That right ends if these terms end. Nothing here transfers ownership of the Service or our content to you.

9.Third-party services

The Service works with other companies, such as Stripe for payments, and coaches may link training videos hosted on other platforms. Those services have their own terms and privacy policies, and we're not responsible for them. Your use of a third-party service is between you and that company.

10.Privacy

Our Privacy Policy explains how we handle information, including our COPPA commitments for players under 13. By using the Service, you agree to that policy.

11.Disclaimers

We work hard to make Train Daily useful and reliable, but the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We don't promise the Service will be uninterrupted, error-free, or that it will produce any particular result. Player improvement depends on many things outside our control. To the fullest extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12.Limitation of liability

To the fullest extent allowed by law, Train Daily and Outsmart Press, Inc. won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim. Some places don't allow certain limits, so parts of this section may not apply to you.

13.Indemnification

You agree to defend and hold harmless Train Daily and Outsmart Press, Inc. from claims, damages, and costs (including reasonable legal fees) that arise from your use of the Service, from content you upload, from your breach of these terms, or from your failure to obtain any consent required to add a player, including parental consent for a player under 13.

14.Termination

You can stop using Train Daily and cancel your subscription at any time. We can suspend or end your access if you break these terms, if we're required to by law, or if we stop offering the Service. If your access ends, the sections of these terms that should reasonably survive (such as ownership, disclaimers, limitation of liability, and indemnification) will continue to apply.

15.Governing law

These terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. Any dispute relating to these terms or the Service will be handled in the state or federal courts located in Indiana, and you agree to that jurisdiction.

16.Changes to these terms

We may update these terms as Train Daily changes. When we do, we'll update the date at the top. If you keep using the Service after a change, that means you accept the updated terms. If you don't agree to a change, please stop using the Service and cancel your subscription.
